If you’re unable to work due to a physical or mental health condition, you may qualify for disability benefits in New Mexico through the Social Security Administration (SSA). But the process of applying for and receiving benefits can be complicated and time-consuming. Knowing what to expect at each stage can help you avoid mistakes and improve your chances of approval.

Here’s a step-by-step guide to help you understand the disability benefits process in New Mexico.

Find out if you qualify for SSDI benefits. Pre-qualify in 60 seconds for up to $4,018 per month and 12 months back pay.

Please answer a few questions to help us determine your eligibility.

Step 1: Determine Which Disability Program You Qualify For

There are two main types of Social Security disability programs:

  • Social Security Disability Insurance (SSDI)
This program is for individuals who have worked and paid Social Security taxes over time. You must have a sufficient work history and be "insured" under SSA rules.
  • Supplemental Security Income (SSI)
    SSI is a
needs-based program for people with limited income and resources. It does not require work credits.

You may qualify for one or both programs depending on your income, work history, and medical condition.

Step 2: Gather Medical Evidence and Personal Information

The strength of your medical documentation will be key to your case. Before applying, make sure to collect:

  • Detailed medical records from all treating doctors
  • A diagnosis and explanation of your condition(s)
  • Treatment history and prescribed medications
  • Lab tests, imaging, and surgical reports
  • Statements from physicians explaining how your condition affects your ability to work

You’ll also need to provide:

  • Employment history
  • Financial details (especially for SSI)
  • Personal identification and contact information

Step 3: File Your Application

You can apply for disability benefits in New Mexico in one of three ways:

  • Online at www.ssa.gov
  • By phone at 1-800-772-1213
  • In person at a local SSA office in New Mexico

Important: Answer all questions honestly and thoroughly. Incomplete or inconsistent information can lead to a denial.

Step 4: Initial Review and Decision

Once you’ve submitted your application, the SSA sends your case to Disability Determination Services (DDS) in New Mexico. This agency will:

  • Review your medical records
  • May request additional exams (called Consultative Exams)
  • Decide whether your condition qualifies as a disability under SSA rules

This process typically takes 3 to 6 months, and many first-time applications are denied.

Step 5: If Denied, Begin the Appeals Process

If your initial claim is denied (which is common), you have 60 days to file an appeal. The appeals process includes:

  • Reconsideration – A new review of your case by someone who wasn’t involved in the first decision.
  • ALJ Hearing – If denied again, you can request a hearing before an Administrative Law Judge.
  • Appeals Council – If the judge denies your claim, you may ask the Appeals Council to review the decision.
  • Federal Court – If necessary, you can file a lawsuit in federal district court.

Tips to Improve Your Chances in New Mexico

  • Stay in regular contact with your doctors and follow treatment plans
  • Respond quickly to SSA requests for information
  • Keep copies of all documents you submit
  • Be consistent and honest about your condition and symptoms
